Mr. Schwartz specializes in reguatory takings, eminent domain, development impact fees, general land use, real estate litigation. He was part of a team of Shute, Milhaly & Weinberger attorneys who won a unanimous decision in the United States Supreme Court in San Remo Hotel v. County of San Fransico, 545 U.S. 323, where the Court determined that adjudication of regulatory takings claims against local government agencies must be conducted in state courts. He is a frequent participant in reguatory takings cases, including Lingle v. Chevron, Kelo v. City of New London, City of Monterey v. Del Monte Dunes, Brown v.
