Urban social exclusion, "agentic individualism" and "regimes of juridicity": a socio-legal approach/ EXCLUSAO SOCIAL URBANA, "INDIVIDUALISMO AGENTICO" E "REGIMES DE JURIDICIDADE": uma abordagem sociojuridica

This article, based on a literature review in the field of socio-legal studies, intends to indicate the existence of "regimes of juridicity", understood as an expression of different forms of implementation of legal regulation distinct from state law, in contexts of urban social exclusion. In order to do so, first of all, based especially on the work of Lucio Kowarick, it makes a brief approach to the problem of exclusion and socioeconomic and civil vulnerability in the urban space of contemporary Brazil. Then, it focuses on some fundamental aspects of the "theory of multijuridism" proposed by Etienne Le Roy to, in the midst of it, situate the concept of "regimes of juridicity". Finally, it seeks to emphasize that the "theory of multijuridism" is a very appropriate analytical instrument for the "decoding" of "regimes of juridicity" in contexts in which, due to social exclusion, is observed a social interaction characterized by what the sociologist Danilo Martuccelli calls "agentic individualism". O presente artigo, a partir de uma revisao de literatura no campo dos estudos sociojuridicos, pretende indicar a existencia de "regimes de juridicidade", entendidos como expressao de diferentes formas de concrecao da regulacao juridica distintas do direito estatal, em contextos de exclusao social urbana. Para tanto, em primeiro lugar, baseando-se, especialmente, na obra de Lucio Kowarick, realiza uma breve abordagem do problema da exclusao e da vulnerabilidade socioeconomica e civil no espaco urbano do Brasil contemporaneo. Em seguida, enfoca alguns aspectos fundamentais da "teoria do multijuridismo" proposta por Etienne Le Roy para, em meio a ela, situar o conceito de "regimes de juridicidade". Por fim, procura ressaltar que a "teoria do multijuridismo" constitui um instrumento analitico muito apropriado para a "decodificacao" dos "regimes de juridicidade" em contextos nos quais, em virtude da exclusao social, observa-se uma interacao social caracterizada por aquilo que o sociologo Danilo Martuccelli designa de "individualismo agentico".
