Summary:This article addresses the issue of judicial control of conventionality and its relationship with the lack of adherence to the fundamental rights of the Yanomami people, an indigenous community in the Amazon region of Brazil. Starting with a brief introduction to the topic, this study explores the context of conventionality control as a mechanism to harmonize national laws with international human rights treaties. The central research problem lies in the analysis of the implications of this control, or rather, its absence, in the Democratic Rule of Law and the protection of human rights, specifically concerning the Yanomami people. The justification for this research lies in the pressing need to understand and address the persistent violations of the fundamental rights of this indigenous community, which faces significant challenges related to land, health, and culture. The methodology adopted included a comprehensive literature review and the analysis of relevant jurisprudence. The results highlight the lack of adherence to the rights of the Yanomami people regarding international human rights treaties, underscoring the importance of conventionality control as a tool to ensure the protection of these rights. In conclusion, this study emphasizes that the effective implementation of conventionality control is essential to ensure that Brazil's domestic standards align with its international human rights obligations. Furthermore, it underscores the urgency of improving the situation of the Yanomami people, respecting their fundamental rights, and promoting a truly democratic and egalitarian society. O estudo explora o contexto do controle de convencionalidade como um mecanismo para harmonizar as leis nacionais com tratados internacionais de direitos humanos. O problema de pesquisa central reside na analise das implicacoes desse controle, ou ainda, da sua ausencia, no Estado Democratico de Direito e na protecao dos direitos humanos, especificamente no que se refere ao povo Yanomami.
