Summary:In the light of the Test-Achats decision of the ECJ, the authors examine whether the exceptions in Art. 5 of the Directive on temporary agency work are consistent with the general right to equal treatment guaranteed in Art. 20 of the Charter of Fundamental Rights and with the principle of coherence. With respect to primary Union law, the authors advocate a restrictive interpretation to the effect that a deviation from the principle of equal treatment would only be allowed for a limited period. This interpretation could also be applied to the interpretation of the German Law on temporary agency work (Arbeitnehmerüberlassungsgesetz — AÜG).
