Summary: | Blackwater is an outstanding civilian staffed American corporation that provides military services under contract to the US Government. Some killings and incidents highlight the challenge of regulating these contractors. Well-established rules of international law apply to States in their relations with private military and security companies. States retain their obligations on the use of force when they contract military services. The UN Security Council should have a say on this subject-matter. This contribution prioritizes the item concerning accountability of private security contractors, namely Blackwater acting in Iraq and Afghanistan, under international and domestic law. Some Blackwater actions have been subject to the US jurisdiction. McMahon v. Presidential Airways Inc. illustrates the point on whether subjecting a contractor to liability under state tort law would create a significant conflict with Government's interests. The legal path is not easy, but there are options. Blackwater est l'une des principales entreprise militaires et de sécurité privées basée aux Etats-Unis. Elle a été impliquée dans des incidents armés en Iraq et Afganistan et elle releve d'un ensemble bien establi de normes du droit international. Les États ne peuvent pas se dispenser de remplir leurs obligations vis à vis l'usage de la force lorsqu'ils recourent à des entreprises. Le Conseil de Sécurité de l'ONU devrait s'impliquer. Cet article se base singulièrement sur la responsabilité de Blackwater en Iraq et Afganistan sur le plan du droit international ainsi que du droit interne. Les tribunaux des Etats-Unis ont accepté certains requêtes qui soulevent des problemes à caractère international. Par exemple, le tribunal dans l'affaire McMahon v. Presidential Airways Inc. a du trancher si la réclamation de dommages devant une juridiction civile est en accord avec les intérêts internationaux du Gouvernement. |
