Summary: | The intense doctrinal debate that has developed over the past three years in Spain has raised doubts of a doctrinal nature in the author's mind, and uneasiness about the lack of definition of the territorial model. From a theoretical point of view it is noticeable that any type of innovation takes precedence over the application of well established doctrines, whether it be in Spain or in Compared Law. From a practical point of view, however, the latest reforms have not been as innovative as one might believe on first sight. Thus the author defends the need to clarify the model and the desirability of defining federalism once and for all. If anything, the changes have formalized what had in practice been introduced previously. To continue in the same way would be a new application of the Lampedusa maxim-keep changing to always stay with the same situation of no definition. [PUBLICATION ABSTRACT] |
