Summary: | Collaborative law is a voluntary, nonadversarial settlement process that enables the collaborative parties and lawyers to negotiate a peaceable and equitable resolution away from the courthouse and free from court control. The collaborative approach utilizes interest-based negotiation to reach a peaceable and equitable settlement by focusing on the needs and values of the parties rather than resorting to positional bargaining and adversarial tactics. Today, collaborative law is a recognized form of alternative dispute resolution (ADR) that is practiced in every jurisdiction nationwide. Unlike other forms of ADR, collaborative parties must be represented by lawyers throughout the collaborative process as a condition to participation. Further, the parties and lawyers must agree to "unbundled" legal services in which the parties retain the lawyers' services for the sole purpose of negotiation. |
