Summary:Ashworth comments on the Court of Appeal's decision in R. v. Lindo (Dwayne Byron Lloyd) case. This judgment raises two points. The first is that it is impermissible to increase the custodial sentence for an imprisonable offence in order to take account of one or more non-imprisonable offences. If Parliament has not provided imprisonment as a penalty for an offence, it is not open to a judge to use that offence as a reason for imposing a longer custodial sentence for an offence for which Parliament has provided imprisonment. The second point concerns the appropriate sentence for the two driving offences. The court stated that it would "serve no purpose" to impose fines, because Lindo had been sent to prison.
