Summary: | This article considers the recent decision in King v Chiltern Dog Rescue [2015] EWCA Civ 581, in which the doctrine of donationes mortis causa , or gifts in contemplation of death, was considered by the Court of Appeal for the first time in over 20 years. The Court held that Vallée v Birchwood [2013] EWHC 1449 (Ch) was wrongly decided and emphasised both the strict limits of the doctrine and the rigorous approach that the courts must adopt when considering the evidence in support of a claim. |
