Summary:Dealing with the German genocide against the Herero and Nama from 1904 to 1908 in the then colony of German South-West Africa has repeatedly been the subject of controversy in the past few years. Representatives of today's Herero and Nama have hitherto unsuccessfully attempted a financial reparation. A new dialogue process has been taking place between the diplomats of today's Namibia and the Federal Foreign Office for more than a year. The contribution examines the legal framework under which the question of possible compensation is negotiated. They are unfavorable to the concerns of the Herero and Nama because they are not entitled to claims against Germany either under German national law or under international law. Finally, the paper looks at the results of the current dialogue process.
