Summary: | Krotoszynski looks at serious and pressing issues regarding the transparency of the terms and conditions associated with accessing information on the Internet. Internet Service Providers and popular search engines go about their business without being called to account for their business practices. The public interest requires that government protect consumers from unfair, abusive, or deceptive trade practices. If a particular search engine sells the right to rig search results, consumers should be aware of this fact. If a search engine blocks content, this too should be disclosed. Content- and viewpoint-neutral regulations to protect consumers from unfair and deceptive Internet practices would not violate the First Amendment and are essential if the Internet is to achieve its full potential as a powerful new marketplace of ideas and information. |
