Summary: | Seven colleagues pay tribute to legal scholar John Hart Ely, who died in 2003 at the age of 65. It is a tragedy, writes Alan M Dershowitz, that Ely was never afforded an opportunity to apply his theory in practice as a Justice of the Supreme Court (or a judge of the Court of Appeals). He was an obvious candidate on any moderate Republican or moderate Democratic president's short list of judicial nominees from academia. He had served with distinction as a public defender, a general counsel to the Transportation Department, and a dean of a major law school. But he refused to tailor his views to the political styles of the day. |
