Summary: | My experience with international maritime arbitration has been first as an advocate, then as a consumer and most recently as an arbitrator. What I say this evening and in this paper reflects my views based on these experiences and are not meant to represent official positions of the Society of Maritime Arbitrators, known as the "SMA." I have drawn on my SMA experience in speaking to the subject chosen by John of "Embracing Maritime and International Arbitration."I will first speak about the origins of the international shipping industry's preference for arbitration and why it continues. Then, I will discuss some distinguishing features of maritime arbitration in New York. Finally, I will express my belief that maritime arbitrators should not be reticent about deploying their commercial expertise in deciding disputes. |
