Summary: | On March 5, 2020, the Peruvian Constitutional Tribunal unanimously rejected the writ of amparo (a procedure for protecting constitutional rights) filed by Jorge Guillermo Colonia Balarezo (petitioner). The Tribunal found that a woman’s right to live free from violence justifies limiting an aggressor’s right to a hearing in certain contexts—here concerning judicial measures to protect women’s physical and psychological integrity. In reaching this conclusion, the PCT relied on and contributed to the development of international law regarding the right of women to live free from violence. |
