Summary:In Mangouras v. Spain, the applicant was the master of the oil tanker Prestige, which broke up off the northern coast of Spain, spilling thousands of tonnes of oil into the Atlantic Ocean and causing an ecological disaster in coastal areas. The applicant and his crew were rescued, and the applicant taken into custody. The investigating judge, taking account of the serious offences with which the applicant was likely to be charged and the fact that he was a Greek national with no ties to Spain, set bail at 3 million. The applicant appealed on the basis that this sum was well beyond his means, but the appeal was turned down and the judge reiterated the reasons of the first judge.
