Summary: | The subject of research of this project is the Croatian system of the execution of the punishment of deprivation of liberty in the context of the penitentiary system of European countries and relevant international documents. There are two aspects to this research subject: a theoretical and scientific aspect, and a practical research aspect. As a result of collecting and studying domestic legislation and subordinate legislation in the area of the execution of the prison sentence, Prof. Irma Kovco Vukadin, DSc, and Prof Vladimira akman-Ban, DSc, produced a Collection of Legislation on the Execution of the Prison Sentence containing basic information on the structure and operation of the Prison System Directorate in the Republic of Croatia, the situation and prospects of the Croatian penal system, and laws, ordinances and regulations in this field. In order to gain a better view of the situation concerning the protection of the rights of prisoners, a collection was made of the jurisprudence of the European Court of Human Rights, primarily all the decisions of the Court related to the Republic of Croatia concerning the protection of the rights of persons deprived of freedom. These documents are compiled in a Collection of International Documents on the Execution of the Prison Sentence. The research aspect of this project primarily focuses on analysing the work of the executing judge in supervising the system of the execution of the prison sentence. For this purpose, a questionnaire was produced for executing judges and court advisors working on the execution of the prison sentence. After a pilot study conducted at the County Court in Split, questionnaires were sent to executing judges and court advisors working on execution tasks in all county courts of the Republic of Croatia. The questionnaire included questions concerning the type and scope of work, the judges' workload, training, first-instance and second-instance jurisdiction, requests for court protection, conditional release, and assistance following release. The aim of the survey was to establish how the institute of executing judge operates and how it has been accepted in the Croatian system of the execution of the prison sentence. The results of the research and an analysis of the results will be published together with other papers produced by researchers working on this Project and by external practitioner associates.
