Summary: | Similar to federal reserved rights, aboriginal water rights exist without the confines of prior appropriation. The Pueblo water rights accorded American Indians by the state laws of California, Arizona, and new Mexico are surveyed. Provisions of the winters doctrine affecting aboriginal water rights are reviewed. Other issues involved, such as the use of groundwater and state jurisdiction of aboriginal water claims, are discussed. |
