Summary: | Air quality agreements that the practicing attorney is most frequently called upon to negotiate and draft are discussed. Such agreements result from enforcement actions or arise during permitting under applicable state or federal regulations. Enforcement/compliance agreements typically become necessary when a source has difficulty with a particular air regulation or emission standard. The two most common types of enforcement agreements are consent decrees and variances. In drafting such agreements, the requirements and approval status of all applicable federal, state, or local regulations must be determined.
