Summary: | Curiously, penalized the German criminal law in [sec] 80 f. Of the Criminal Code only planning and preparing a war of aggression, the implementation of such a war is not punishable. The clear Ponalisierungs order of Art. 26 para. 1 sentence 2 of the Basic Law, the legislature has only partially met and spoken out so that also let miss a clear fact of international law. Now, the international law has done his duty, because in the summer of 2010, the Assembly of States Parties of the International Criminal Court has agreed on a definition of the offense crime of aggression.
