Summary:Since the introduction of Environmental Impact Assessment and Strategic Environmental Assessment Directives and transposed Regulations in the UK, there has been much debate about their utility. There is, therefore, the need to evaluate how these assessments fit into the new planning system, especially, how they relate to the production, adoption and implementation of planning documents. Adopting the qualitative research methodology based, particularly, on the case study philosophical approach and relying heavily on email questionnaires as the data collection method, the use of the environmental assessments is examined by analysing the legal relationships between the Directives and evaluating their implementation in real estate development projects. Sutton London Borough Council is used as a case study. It has been established that although there is a reasonably good understanding of the planning system by stakeholders, what appears to be lacking is appropriate direction and, therefore, there is the need for detailed guidance from central government. Regarding areas of overlap, the study shows that albeit there are problems associated with the way the laws are drafted both in the European Union Directives and the UK Regulations, the biggest potential areas of overlap occur at the implementation stage, seemingly due to a lack of understanding. Thus, education is needed in this regard.
