Summary:Article 104 of the Charter provides that "[T]he Organization shall enjoy in the territory of each of its Members such legal capacity as may be necessary for the exercise of its functions and the fulfilment of its purposes." In parallel to this provision, Article 105, paragraph I, provides that "[T]he Organization shall enjoy in the territory of each of its Members such privileges and immunities as are necessary for the fulfilment of its purposes." These Charter provisions have been implemented in a detailed manner by the Convention on the Privileges and Immunities of the United Nations (hereafter the General Convention). This paper -- a companion to the author's papers on the privileges and immunities of experts and officials -- is an account of the published practice of the Organization in respect of the privileges and immunities that attach to the Organization as such.
