Summary: | Empirical review of actual police interrogation practices and criminal justice system outcomes suggests that decisions made regarding invoking Miranda protections and criminal confessions have a significant impact on conviction rates. Legal scholarship has paid little attention to police practices and has focused on issues addressed at the appellate level. Different criminal justice experiences and choice of interrogation tactics influence conviction and sentencing. Police practices would not be considered coercive under case law, but invocation of Miranda rights clearly subjects suspects to different police treatment. |
