Summary: | If it is impossible to resolve a dispute by negotiation and agreement, the next best thing is arbitration, which can provide a better solution than litigation. The Arbitration Act 1996 has given arbitrators very extensive and significant new powers. The Act gives the arbitrator the right to decide whether or not he or she has jurisdiction to deal with the dispute. Parties are free to choose for themselves the rules they wish to govern the arbitration. The arbitrator generally has immunity against claims by parties or others. |
