Summary:While the problems of copyright mirror those of inventions,33 the nature of copyrightable materials permits a simpler solution to the definition problem than the more ephemeral "inventions." More simply, since copyrights come into existence when the idea is placed on a tangible medium,36 creation and reduction to practice are not distinguishable. As a result, capturing a definition of the software37 in the contract becomes a relatively straightforward exercise.
