Summary: | In a marketplace that has less tolerance for costly project delays and litigation, alternative dispute resolution is meeting a growing need for many companies and government agencies. The use of a neutral is becoming more common to mediate negotiated settlements of contested permit conditions, negotiated rulemakings and negotiations of consent agreements for environmental violations. In a mediated or facilitated negotiation, a neutral can produce a win-win agreement that saves time and money for the parties involved, while building goodwill and trust with interested stakeholders. An example of a successfully mediated negotiation is the recent Saco River Fish Passage Agreement. The negotiation involved almost 2 dozen parties, including Central Maine Power Co. - the owner of 6 hydro projects, several state and federal regulatory agencies, municipal governments, a private dam owner, and a coalition of 6 environmental organizations. |
