Summary:After more than six inspections by the DENR, the Pollution Adjudication Board (PAB), and the municipal government from January 2001 to October 2001, FMC was found to be in compliance with DENR regulations. The PAB ruling vindicates what FMC has been asserting for the past two years: FMC has not violated the DENR effluent standards. This is the first factor in the DENR findings as written on page 33 of the document. 1. Ms. [Marites S. Villamor] wrote: American seaweed processor FMC Marine Colloids Phils., Inc. has been directed to clean the Mactan Channel, especially the area near its submarine discharge pipe... While the board said FMC "has not violated the DENR effluent standards," based on the analysis of the samples taken by the Environmental Management Bureau in 2001, it said the pollution case against the American company was not "entirely baseless." FACT. High potassium content is not an issue. Don't be misled by it. Potassium, at any levels, is safe. Recall that we even ingest this from eating bananas and our multivitamins. The decision reads further, "However, the board has directed FMC to clean up the black mounds found in the vicinity of its submarine discharge pipe in the Mactan Channel. FMC has also been ordered to replace its existing submarine pipe with an elevated discharge pipe directed seaward and bent 90 degrees downward to a depth where a good mixing zone is located." In fact, the latest study from the Mactan Channel Multi- Sectoral Management Council, an environmental NGO, confirmed that Mactan Channel is highly polluted. However, with so many sources of pollution that flow into the Mactan Channel, this cannot be traced to any single source.
